The Regular Meeting of the Ventnor City Board of Commissioners was called to order by Mayor Kreischer in Commission Chambers, City Hall on May 17, 2007 at 6:00PM following the Pledge of Allegiance.

Present: Commissioners Schafer, Vespertino and Mayor Kreischer
Present from Solicitor’s Office: J. Scott Abbott, Esq.

Mayor Kreischer announced that “Pursuant to the Open Public Meetings Act adequate notice of this meeting has been provided in conformance with said law”.

The minutes of the May 3, 2007 Regular Meeting were approved as written. (Oral reading waived)

2ND READING (PUBLIC HEARING) OF ORDINANCE 2007-04
AN ORDINANCE AMENDING AND SUPPLEMENTING
THE TOWING PROVISIONS OF THE CITY OF VENTNOR CITY
The City Clerk read the Public Notice on Ordinance 2007-04 after which Mayor Kreischer announced the Public Hearing was open and anyone could be heard speaking for or against the Ordinance.
There being no one wishing to be heard, Cmr Schafer moved, seconded by Cmr Vespertino the Public Hearing on Ordinance 2007-04 be closed.

RECEIPT OF SUPPLEMENTAL DEBT STATEMENT
The City Clerk reported that she was in receipt of the supplemental debt statement prepared as of 5-17-07.
Cmr Vespertino moved, seconded by Cmr Schafer the supplemental debt statement be received and filed according to law.

AN ORDINANCE AMENDING AND SUPPLEMENTING

Cmr Vespertino moved, seconded by Cmr Schafer that Ordinance 2007-05 be introduced.

INTRODUCTION OF ORDINANCE 2007-06
BOND ORDINANCE APPROPRIATING THE SUM OF $450,000 FOR REHABILITATION OF VENTNOR FISHING PIER IN THE CITY OF VENTNOR CITY, IN THE COUNTY OF ATLANTIC, NEW JERSEY. APPROPRIATING $143,750. AS THE RESULT OF A GRANT FROM THE STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION GREEN ACRES PROGRAM AND AUTHORIZING DEBT IN THE FORM OF A LOAN FROM THE STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION, GREEN TRUST LOCAL ASSISTANCE PROGRAM, IN THE AMOUNT OF $306,250, AND AUTHORIZING THE ISSUANCE OF ANY FINANCING DOCUMENTS AS SPECIFIED IN A GREEN TRUST PROJECT AGREEMENT TO BE EXECUTED BY THE CITY OF VENTNOR CITY AND THE STATE OF NEW JERSEY, DEPARTMENT OF ENVIRONMENTAL PROTECTION.

RESOLUTION NO. 56 OF 2007 – TAX REFUNDS, OVERPAYMENTS
RESOLUTION NO. 57 OF 2007 – AMENDING TEMPORARY BUDGET

RESOLUTION NO. 58 OF 2007 – AWARD OF CONTRACT FOR 2007 REHABILITATION OF MUNICIPAL PIER
WHEREAS, the Municipal Clerk of the City of Ventnor City received in her Office on Tuesday, March 13, 2007 at 10:00 A.M. four (4) separate bid proposals for the 2007 REHABILITATION TO MUNICIPAL FISHING PIER at Boardwalk and Cambridge Avenue in the City of Ventnor City; and
WHEREAS, the Municipal Engineer has reviewed same and has herewith recommended award to the apparent lowest responsible bidder, Midlantic Construction, L.L.C. of Manasquan, N.J.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Ventnor City that it hereinafter awards the Contract for the 2007 REHABILIATION TO MUNICIPAL FISHING PIER at Boardwalk and Cambridge Avenue to the apparent lowest responsible bidder, Midlantic Construction, L.L.C. of Manasquan, N.J., for their Total Amount Bid of $2,662,169.00; and
BE IT FURTHER RESOLVED that a Certificate of Availability of Funds issued by the Municipal Chief Financial Officer shall be attached hereto.
Cmr Schafer moved, seconded by Cmr Vespertino that Resolution No.58 of 2007 be adopted.
