We have great news for you.
The golf course will not be built!
The Planning board approval has been rescinded and the developer has stated in a letter that they are not going to build or pursue a variance to build the golf course.
Now we have some more work to do and we need to tie up a few legal ends.
We also must deal with the changing of the Margate City Ordinance that allows Amusement businesses to be built or open in the Central Business District.
I want to thank all of you for all of your hard work. Your letters and telephone calls has made this a successful effort. You should be proud of all your hard work.Your committee could not have accomplished this without you

The e-mail had a very long send-out list. Very long.
Earlier, there was an article from Downbeach Current at

...and it prompted an inquiry, since previously it had appeared that the matter was a situation where the lawsuit was filed but put on hold pending another review by Planning.

Here is where we stand. There was a conference last month with the Superior Court Judge. Baylinson stated that there were problems and he requested the case go back to the Planning board. The judge said ok work that out amongst the plaintiffs, defendants and the bank
Since then Baylinson was told by the bank that they either settle immediately or come up with another 200k
Baylinson notified us that they were pulling out of the deal
The complaint still sits in Superior Court since we will not pull the complaint until we have assurances, in writing that the developer is moving on and that the bank will not pursue this with the planning board hearing to ask for the variances. The bank has stated that they want no part of this and do not want to go into the devlopment business and pay for the legal aspect of going before the planning board.
So our complaint still sits and nothing has happened so far but our attorney .... hopes to have this completed by next week.
....[T]hrough the grapevine that the Mayor and at least two other planning board members are voting against this since they saw how unpopular this is.
[Organizers & supporters of Sink their Ships] have been hitting the business association hard as well and there are only two business owners who support this project. XXXXXXXXX and XXXXXXX.
